Here is a bit of news that we came
ran across as it applies to our internet marketing in Naples FL for
our clients.
As much as that Big Mac on TV looks
tasty, chances are, you won't get it in that form. With a bit of
photo editing magic, any "deflated" foodstuff can look good
for advertisement. The
Federal Trade Commission
(FTC) is clear on the matter: "Advertising must tell the truth
and not mislead customers." Yet, for some reason, fast food
joints keep finding ways to go around the roadblock.
As to the legality of these ads,
it's a story for another time. However, you definitely would want to
show customers what they would be buying from you, regardless of
appearance. If you don't get in trouble with the law, you probably
will with your customers. Compared to law, where due process can take
weeks or months, zero customers have an immediate effect.
Then again, perhaps imagery should
be the least of your worries in this case. If past lawsuits are
anything to go by, consumers are more concerned about claims. The FTC
is clear on this matter, too: "In addition, claims must be
substantiated." Activia touted its "clinically-proven"
benefits, only to pay $45 million in damages for it.
Whether or not you're in the food
business, always follow the FTC's two commandments of advertising:
Be honest and be accurate.
